Bargain Host provides World Wide Web page hosting. Bargain Host reserves the right to suspend or cancel a customer's access to any or all services provided by Bargain Host when Bargain Host decides that the account has been inappropriately used or otherwise.
SERVER USE
Personal accounts are to be used by the
primary owner only. Personal account holders
are not permitted resell, store or give
away web-hosting services of their website
to other parties. Web hosting services are
defined as allowing a separate, third party
to host content on the owner's web site.
Exceptions to this include ad banners, classified
ads, and personal ads.
Bargain Host reserves the right to refuse service and /or access to its servers to anyone.
Bargain Host do not allow any of the
following content to be stored on its servers:
Restricted Scripts - We will suspend any accounts found to be using popular bulletin boards such as yabb.cgi, ikonboard.cgi. Due to heavy resource usage by these scripts we will not allow them on our servers, you must use the bulletin board scripts provided with your hosting account.
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
Adult Material - Includes all pornography,
erotic images, or otherwise lewd or obscene
content.
Warez - Includes pirated software,
ROMS, emulators, phreaking, hacking, password
cracking. IP spoofing, etc., and encrypting
of any of the above. Also includes any
sites
which provide "links to" or "how to" information
about such material.
HIGH
RESOURCE USER POLICY
Resources are defined as bandwidth and/or
processor utilization.
Bargain Host may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available Bargain Host reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.
PAYMENT POLICIES
All accounts are set up on a prepay basis.
Although Bargain Host reserves the right
to change prices of accounts or services
at any time all pricing is guaranteed
for
the period of prepayment. Payment is due
yearly following the date the account
was established, you will not be charged
again after this period unless you wish
to continue using our services, an email
reminder will be sent out 30 days before
payments are due.
Invoices
will be sent directly to customers via
email shortly after the online purchase
has been
made.
PAYMENT
OPTIONS
In order to streamline our accounting procedures
and keep costs down Bargain Host runs a
limited number of payment options.
Credit
/ Debit Cards:
Bargain Host accepts all major Credit Cards
including Mastercard, Visa, Discover, Switch & Solo.
DOMAIN
REGISTRATION
Domain names will be registered automatically
on receipt of cleared payments and will
be registered in the owners name. If you
have made a spelling error there is no
refunds on domain name, but we can normally
rectify any miss-spelled domains within
3 days of notice.
CANCELLATION AND REFUNDS
Bargain Host reserves the right to cancel
the service at any time. In this event customers
will be entitled to a pro rata refund based
upon the remaining period of membership
less domain registration costs. In the event
of Bargain Host terminating a customers
account due to a situation beyond Bargain
Host's control, the customer is not entitled
to a refund. In this event Bargain Host
will attempt to offer an alternative service
at Bargain Host's own sole discretion. Bargain
Host's does not guaranteed that an alternative
service will be offered or be available
to the customer.
If a customer contravenes Bargain Host' terms of service a refund will not be issued in the event of a cancellation by Bargain Host and/or the customer.
Customers may cancel their account at any time. Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund if the Customer cancels the account prior to the renewal date. In addition accounts that incur domain name registration fees are also non-refundable.
INDEMNIFICATION
Customer agrees that it shall defend, indemnify,
save and hold Bargain Host harmless from
any and all demands, liabilities, losses,
costs and claims, including reasonable attorney's
fees asserted against Bargain Host, its
agents, its customers, officers and employees,
that may arise or result from any service
provided or performed or agreed to be performed
or any product sold by customer, its agents,
employees or assigns. Customer agrees to
defend, indemnify and hold harmless Bargain
Host against liabilities arising out of;
(1) any injury to person or property caused
by any products sold or otherwise distributed
in connection with Bargain Host' server;
(2) any material supplied by customer infringing
or allegedly infringing on the proprietary
rights of a third party; (3) copyright infringement
and (4) any defective products sold to customer
from Bargain Host's server.
DISCLAIMER
Bargain Host will not be responsible for
any damages your business may suffer. Bargain
Host makes no warranties of any kind, expressed
or implied for services we provide. Bargain
Host disclaims any warranty or merchantability
or fitness for a particular purpose. This
includes loss of data resulting from delays,
nondeliveries, wrong delivery, and any and
all service interruptions caused by Bargain
Host and its employees. Bargain Host reserves
the right to revise its policies at any
time.
Any illegal activity, including adult content, links to adult content web sites, spamming or hacking will result in your site being shut down and all your files deleted without warning.
ANTI-SPAM
POLICY
BargainHost defines spam
as any type of unsolicited commercial email
(UCE) or unsolicited bulk
email (UBE) for any purpose. This includes,
but is not limited to, the following items:
Using a non-existent return email address
when sending commercial solicitations.
Mail-bombing (sending numerous messages
to the same user).
Subscribing someone else to a mailing list
without that person's permission.
Posting the same article to multiple off-topic
newsgroups.
Sending, being involved in sending, or
employing a third party to send mail which
advertises or mentions a site hosted at
BargainHost to users that have not specifically
requested this mail.
Any kind of forged header information.
Lists which include "harvested" addresses.
"
Targeted" email lists.
Using a script on your site to send bulk
or unsolicited e-mail.
Using an autoresponder at your site to
send bulk or unsolicited e-mail.
Sending mail to users who have not specifically
requested to receive such mail, including
opt-out mailing lists.
Distributing or advertising software designed
to aid in the delivery of UCE.
Please note that this includes all domain
names, IP addresses, and e-mail addresses
at a site. Any of the above items would
be considered a violation of our policy.
Sending unsolicited commercial email may be acceptable under the circumstances outlined below:
You should have a prior relationship with
the person receiving the email, and they
should be aware that they will be receiving
email from your domain.
If you have a subscription list, there
should be a confirmation email sent to
the address before that address is added.
There should always be a way to quickly
and easily unsubscribe from the list included
in each email, and all unsubscription requests
should be quickly honored.
A valid "From:" and "Reply
to" address must be included with
each message.
If a client is found in violation of the
above no-spam policy, the offending account
may be terminated without notice, and no
refund will be issued. In the event that
BargainHost at any time reasonably believes
that the Customer is in breach of any of
the terms and conditions or is using BargainHost
services in an unacceptable manner, BargainHost
may immediately terminate their account
without liability. At the time of termination,
the Customer shall be responsible for the
entire amount of the most recent statement
and any excess usage charges at the time
of termination.
Please contact our Abuse Department to report spam by a BargainHost customer, or for other questions regarding this policy. When reporting spam, please include the full headers of the email messages that you are making a complaint about. The information in the headers of email messages is important in confirming the origin of the offending email.
BargainHost reserves the right to make amendments or changes to this policy.
